Distance Sales Agreement & Preliminary Information Form

Rights and obligations of parties regarding digital service purchases.

Article 1 - Parties

Seller (Trainer)

The person providing the service via the Platform. The relevant Trainer's name, surname, and contact information are presented to the Buyer before purchase and on the profile page.

Intermediary Service Provider

Buyer: The person purchasing the service from the website (mentoris.app or subdomains) or mobile application.

Article 2 - Subject

This agreement regulates the rights and obligations of the parties regarding the BUYER's purchase of online consultancy/training services belonging to the relevant TRAINER via the mentoris.app infrastructure.

Article 3 - General Provisions

  • 3.1. Under this Agreement, Mentoris ("Company" or "mentoris.app") holds the title of Intermediary Service Provider solely within the scope of Distance Contracts Regulation. The Buyer accepts that Mentoris has no direct responsibility regarding the content, quality, or results of the service.
  • 3.2. The order price will be collected through the payment institution (Stripe, etc.) contracted by Mentoris, and by paying this price, the Buyer will be deemed to have paid the service fee to the Seller. Mentoris only provides payment and intermediary services.
  • 3.3. The parties to this Agreement are the Buyer and the Seller (Trainer). The main responsibilities regarding the performance of the Agreement belong to the parties. This agreement enters into force on the date it is electronically approved by the Buyer.
  • 3.4. The Buyer accepts that they have read and understood all information regarding the characteristics and sales conditions of the service and have given the necessary approval electronically.
  • 3.5. If the service fee cannot be collected or is cancelled for any reason, the provision of the service will be stopped.
  • 3.6. The Buyer and Seller are responsible for the accuracy of the information they enter into the system. Mentoris is not obliged to verify the accuracy of the entered information.

Article 4 - Definition and Content of Service

The Seller (Trainer) provides the following services to the BUYER according to the selected package:

  • Online Consultancy/Training Packages: The BUYER selects the package suitable for their needs via the packages page.
  • Digital Content: Workout programs, nutrition plans, or training videos.

The service will be provided digitally via the Mentoris infrastructure.

Article 5 - Order and Payment

The BUYER selects and orders the service via the website. Payment is made through the secure payment platform (Stripe) contracted with Mentoris. Access to the service is provided after the payment transaction is approved.

Article 6 - Delivery

After purchasing the service, the BUYER accesses the service by logging into the panel. The consultancy service will be provided via the system (messaging, file sharing, form tracking, etc.) according to the trainer's schedule and the content of the package.

Article 7 - Cancellation and Refund

  • 7.1. In digital content and instantly performed services, the right of withdrawal ends with the start of the service (opening of access).
  • 7.2. If the service has not yet started or if a special return policy has been specified by the Trainer, the Buyer may request a refund. Refund requests are primarily evaluated by the Trainer.
  • 7.3. In case of inability to access the service due to a technical error, Mentoris may initiate the refund process. The refund transaction is carried out to the card used for payment via the bank.

Article 8 - Liabilities

The SELLER (Trainer) is responsible for the quality and content of the consultancy service provided to the BUYER. The BUYER accepts that results may vary from person to person according to the service provided and no guarantee is given.

Article 9 - Privacy

  • 9.1. The SELLER uses the BUYER's personal information solely for the purpose of providing the service.
  • 9.2. Processing of personal data is carried out within the framework of Mentoris Privacy Policy and GDPR Statement. The Buyer consents to the sharing of necessary data with the Trainer for the performance of the service.

Article 11 - Validity

The BUYER accepts this agreement by approving it electronically via the website. The payment and approval transaction made electronically means that the Buyer has read and accepted the terms of the agreement.
